Memberships

Artist Membership

  • Artist membership is required. The current membership rate is $50 a year.
  • Receives full membership benefits and 50% of their art sales.
  • Artist members contribute to gallery operations 1-4 days per month.
  • Artists who do not want to contribute to the committees pay $100 a year, and receive full membership benefits and 50% of their art sales.
  • Artists who do not contribute to the gallery and have an unpaid membership fee forfeit their benefits, are asked to retrieve their artwork and/or owe a payable commission of 25% from their sales.
  • New artist applicants must submit their proposals on the website with a $5 artist application fee.

Ownership

The artist warrants and represents that all artworks offered to The Exhibit, LLC are the artist's original creations; that the artist is the sole and absolute owner and holder thereof and all the rights and copyrights hereto; that the same are free and clear of all liens and encumbrances; and that the artist has a right to sell the same.

Delivery of work

All work must be accompanied by an invoice. Clearly mark each piece with the following information: title, description, size, medium, artist's price, and product numbers (where appropriate). Hawaiian titles and terms should be accompanied by English translations. Shipping and delivery costs are to be paid by the artist.

Return of work

Work will be displayed for at least one month. Thereafter, work may be returned at any time at The Exhibit's discretion. It is the artist's responsibility to notify The Exhibit of any address changes. Artists not doing so are assumed to have donated their work to The Exhibit, LLC. The Exhibit takes all measures necessary to insure that the work arrives safely, including crating if necessary. All return shipping costs are the responsibility of the artist. Notification will be made regarding the return of artwork. Big Island artists who fail to retrieve work within three months of the notice are deemed to have donated their pieces to The Exhibit, LLC.

Work must be ready to display

Work must be ready to display. Two-dimensional art should preferably be framed with Plexiglas due to Hawaii's humidity. Loose works on paper must be shrink-wrapped for protection, and matted or mounted on artboard. Three-dimensional work must be ready to display. Any items needed to better display must be accompanied with the artwork.

Liability

The artist, for himself and his heirs, successors, personal representatives and assigns, hereby agrees directly or indirectly to indemnify, defend and hold harmless The Exhibit, LLC, its directors, employees and consultants, and their respective heirs, successors, personal representatives and legal representatives from and against all losses, claims, demands, suits, or damages (including reasonable attorney's fees) resulting from, and arising out of, or connected with the artist's work or participation.

Payments

The artist is responsible for setting the amount he/she wants to be paid for each work and submitting a detailed invoice for payment. Consignments payments/checks are processed monthly and due to the vendor no later than 60 days of the sale. Checks returned to The Exhibit for incorrect address will be held for six months, after which they will be cancelled. It is the artist's responsibility to notify The Exhibit of any address changes.

Consignment. No exceptions. Terms are based on membership tier.

Outside sales

Artists who sell the same or substantially similar work elsewhere, including through the internet, agree to maintain uniform prices. If the artist sells a piece to an Exhibit customer outside of the gallery, the artist will maintain the uniform retail price and honor a 20% referral commission pay out to The Exhibit Gallery. General excise tax

All businesses must obtain a Hawaii Tax Identification Number (HI Tax ID) and all required tax licenses according to Hawaii State law. General Excise Tax - GET is a tax on your gross business income. If you are an independent contractor or self-employed you will receive a Form 1099-MISC from The Exhibit, LLC if you earned at least $600 during the tax year.

Promotional materials

All participating artist are required to promote yourselves as well as The Exhibit Gallery to better market the exhibition. Examples of marketing include emails, social media, flyers, newspaper, radio and verbal communication. (#TheExhibitGallery, @TheExhibitGallery, #galleryofartandevents) Recommended that each artist shall provide a biography (maximum: one page) as well as information about their work that the gallery can provide to purchasers. Include process and/or method, care, inspiration, and selected shows. Biography information shall be updated by the artist as necessary. A high resolution digital copy of images is recommended for online uploading.

Photo, video and voice recording

Artists consent to and authorize use of photographs and /or video taken of the artist and/or their work. The Exhibit is free of all claims and demands arising out of or in connection with the use of the photographs, images and text, including any and all claims for libel.
